2.9 You engage in conduct that interferes with or disrupts the Service or the use of the Service, servers or networks associated with the Service by others; does not follow the requirements, procedures, policies or regulations of the networks connected to the service.

2.10 You violate the policies on spamming according to Decree 90/2008/ND-CP dated August 13, 2008 of the Government on anti-spam or legal documents valid at the time of doing the work. spamming (http://www.vncert.gov.vn/files/90-2008ND-CP.doc)

2.11 You violate the current regulations of the Ministry of Information and Communications as well as the current provisions of Vietnamese law on illegal acts on the internet.

Article 3: Rights and obligations of customers

3.1 As a customer, you have full rights and obligations of the service hirer – as stipulated in the Civil Code and Commercial Law of Vietnam and other relevant laws.

3.2 You must have the legal status and capacity under the law to enter into a contract with Cyberbase. You commit that you are not a person who has lost or restricted his civil actions, is bound to a third party, is related to a judgment or decision of a competent state agency or is prohibited from performing civil transactions. involvement in Cyberbase's services. 3.11 You must understand and agree that Cyberbase's storage services are backed up for the purpose of recovering from technical, infrastructure, equipment failures and not for the purpose of providing copies to customer. It is therefore your responsibility to periodically back up all your data stored on Cyberbase's servers and keep it safe. 3.15 Method of removing information from Cyberbase:

Article 4: Cyberbase's Rights and Responsibilities

4.2 Cyberbase is committed to supporting customers in using products and services provided by them during the time customers use Cyberbase's services. Article 5: Regulations on payment

5.2 Cyberbase will issue an e-invoice after receiving full payment from you and the service is activated successfully.

Article 6: Regulations on service extension

6.1 You or a service manager designated by you (for businesses, organizations) is responsible for proactively monitoring information about the operational status, validity of products and/or services registered to use at Cyberbase.

6.2 Renewal of service use is only possible when Cyberbase receives the full service fee. The renewal will be completed within 1 day from the time Cyberbase receives the full renewal service fee.

6.3 Customers actively contact Cyberbase and proceed with the extension and payment of service fees according to the following provisions:

· Domain name “.VN” and international domain name – payment of fees, maintenance service 10 days before the expiration date.

· Hosting services on the server (Cloud hosting, Cloud Server, Email, server rental, email server rental, transmission line) - pay the service fee 07 days before the expiration date.

· Software license rental service - pay the service fee 07 days before the expiration date.

SSL Service – pay the service fee 10 days in advance before the expiration date.

· All other services not mentioned above – pay the service fee 10 days before the expiration date.

6.4 Automatic renewal feature (Auto Renew) if you use it at the management page id.Cyberbase.vn is just a channel that Cyberbase built to support you proactively in managing service renewal, but also comply with all provisions of this Article 6.

6.5 Cyberbase cannot and will not be responsible or liable for any consequences or damages arising from your failure to comply with this provision.

Article 7: Suspension and termination of service use

7.1 The service provided by Cyberbase will be automatically terminated/suspended according to the agreement of the two parties or until the expiration of the contract.

7.2 Cyberbase reserves the right to suspend the performance of the contract or unilaterally terminate the service contract in the following cases:

7.2.1 You have violated the provisions of Last Article: Terms of Service of CBT in the process of using our products and services.

7.2.2 You do not cooperate and do not respond to coordinate additional documentation required under Article 3.6 of this CBT.

7.2.3 You do not renew and pay the overdue fees for using the service to Cyberbase within 15 days from the time the service expires. Cyberbase is not responsible for the above cases of non-payment of fees or overdue payments.

7.3 Before terminating the service, you are responsible for migrating all data stored on Cyberbase's servers yourself. We will not transfer or FTP your data to another provider. If you do not move website or server data out of our systems before terminating the service, these data will be deleted and we will not be able to provide backups for those who use them. this data.

7.4 For Trial or Free (Free) services: As soon as the service ends, all of these products and associated services and data (if any) will be destroyed or withdrawn. .

Article 8: Regulations on supplementing and adjusting customer information during service use

8.1 The adjustment of customer information will be done within a maximum of 3 working days from the time Cyberbase receives information on the procedure for requesting modification and adjustment of information. Cyberbase cannot and will not be liable for, nor indemnify, for any consequences or damages arising from your failure to comply with this provision.

8.2 The information requested to be amended or adjusted includes:

8.4 Requests to change related information may incur costs.

Article 9: Customer support

9.1 Cyberbase is not responsible for responding to inquiries or complaints from third parties regarding your use of the service. Cyberbase is also not responsible for responding to inquiries or complaints regarding third-party services you are using.

9.2 Cyberbase provides technical support services to your designated manager in accordance with the support guidelines applicable to the Service.

Article 10: Limitation of Liability and Disclaimer of Warranty

10.5 Cyberbase does not perform SSL installation when requested by you for the following situations:

10.5.1 Your SSL Certificate is not a registered service at Cyberbase.

10.5.2 Your SSL certificate is registered at Cyberbase, but requires technical support to install on a system that is not hosted at Cyberbase (Cloud Hosting, Cloud Server, Email).

10.5.3 Install SSL inside our unsubscribed Cloud Server for Premium Support Plans.

10.6 There may be factors beyond our control that lead to product failure. We will try to fix product defects to bring satisfaction to customers, but we are not responsible for supporting or compensating customers for the above risks and damages (if any).

10.7 You agree to defend, indemnify and exclude Us from all liabilities, damages, losses and expenses including but not limited to court fees, attorneys' fees and related consultants' costs. to the settlement of or arising from your breach in the course of using our product.

10.8 You understand and agree that We will not be liable for damages and consequences arising out of it (including but not limited to damages to profits, reputation, use of data or other intangible damages (even if We have advised you of the possibility of such damages)) from: (i) Cyberbase services, materials and products; (ii) the usability or unusability of the service; (iii) unauthorized access to or modification of the data or information you transmit; (iv) the actions of any third party on the service; (v) products or messages sent or received using the service; or (vi) any other matter relating to the services, materials or products.

Article 12: Free Service

To the extent permitted by law and operating in its sole discretion, Cyberbase may provide one or more free services to its users. Free service coverage is at Cyberbase's discretion.

All intellectual property rights existing in Cyberbase products and services belong to Cyberbase or are legally licensed for Our use, whereby all legal rights are guaranteed. Except with Cyberbase's consent, you may not upload, post, publish, reproduce, transmit, or distribute in any way, any component of Cyberbase's products or services.

When files, images, software, programs created by Cyberbase are in a downloadable state, we permit you to use them to a limited extent for non-commercial purposes, but this permission does not means that Cyberbase has allowed you to exploit the copyright. You may not download the files for reproduction, posting, announcement, transmission, or distribution. In addition you must follow other instructions we establish when you want to use these files.

The user is solely responsible for the information obtained when accessing the Website. We are not responsible for any guarantee as to the source of the information and the accuracy or completeness of such content.

You may stop using our Services at any time. Cyberbase will constantly change and improve its Services. We will notify you in a reasonable time in advance when there is a change or improvement in the functionality of our service.

Article 13: Refund Policy

Refund applies to all services provided by Cyberbase (except services: Domain, SSL, License – no refunds). Please see details at the Refund Policy page.

• For Hosting and VPS services: 100% refund within 07 days from the date of service registration. After 07 days, the corresponding amount will be refunded after deducting the service amount used by day.
• For Server services: refund the corresponding amount after deducting the service amount used by day.
• Promotions come in two forms:
  • No refund method: no refund after 07 days as mentioned above.
  • Applying a refund will be charged as follows: Total amount transferred by the customer – used cost (non-promotional value / service cycle * number of days used) = Refund amount to guest.

Article 14: Service time reservation policy

In the process of using the service at Cyberbase, you can reserve the time to use the service to save and avoid wasting resources when there is no need to continue using the service. For example: You have just signed up for a 12-month hosting service at Cyberbase but have only used it for 1 month, your website design project has not been completed and has to be suspended. Instead of letting the hosting expiration time decrease, you should use this reservation feature to preserve the remaining 11 months of unused hosting. When using this feature you must adhere to the following policies:

14.1 The service term reservation only applies to the following MAJOR service types listed below: Email Pro, Email 4B, Cloud Hosting.

14.2 Cyberbase only makes a reservation for the expiration of the service. Any problems related to the data of the service you automatically back up. Cyberbase is not responsible for the integrity of your data.

14.3 During the service term reservation, you will not be able to use or perform any operations related to the reserved service. Also during the reservation period, you also cannot ask Cyberbase to reopen the service before the deadline. The service will automatically reactivate according to the time frame you selected.

14.4 Reservation policy applies when the service has an expiration time of more than 2 months. Each service is reserved only once during use in Cyberbase.

14.5 The service term reservation feature is actively selected and activated by you directly at Cyberbase.vn. Currently this feature is being applied to retail customers.
